Last updated: 22 October 2026 · version 2026.10.22.1
These terms govern the Secunary app (Part A, terms of use) and everything you order through it (Part B, terms of sale). You accept Part A when you create your account, and Part B each time you confirm an order: the version in force on that day applies to that order. The contract can be concluded in English or in French; both versions are equally authentic and, if they differ, the version more favourable to the consumer prevails.
01Who we are
The Secunary app and the concierge service are provided by SECUNARY, a French simplified joint-stock company with a single shareholder (SASU) with a share capital of €100, registered with the Paris Trade and Companies Register under number 942 117 771, whose registered office is at 102 avenue des Champs-Élysées, 75008 Paris, France. VAT number: FR14942117771. President: Naim Morisson.
Director of publication: Naim Morisson, President. The app’s content and data are hosted by Apple Inc. (iCloud), One Apple Park Way, Cupertino, CA 95014, United States, +1 408 996 1010, and by Google LLC (Firebase), 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States, +1 650 253 0000.
Contact: support@secunary.fr, +33 6 66 76 80 57, or the messages with your concierge in the app.
02Words used in these terms
“You” or “the client”: the person who holds a Secunary account. “Concierge”: the Secunary team member who handles your requests. “Request”: what you ask for in the app. “Proposal”: a priced offer your concierge sends in reply. “Order”: a proposal you confirm and pay. “Supplier”: the hotel, owner, operator, restaurant, boutique or other company that performs a service or provides a good. “Consumer”: a client acting for purposes outside their trade, business or profession.
03Part A — Your account
You sign in with your Apple ID. You must be at least 18 and give accurate information, which you keep up to date. Your account is personal: you keep your device and your Apple ID secure, and you tell us straight away if you think someone else is using your account.
Guests may browse the app without an account. Sending a request requires an account.
You can delete your account at any time in the app (Settings › Delete my account). Orders already confirmed remain due and are performed under these terms.
04Part A — Using the app
You use the app for your own requests, in good faith and in accordance with the law. You must not use it to commit fraud, to make requests in another person’s name without their agreement, to send unlawful, offensive or threatening content, to disrupt the app, to copy or extract its content automatically, or to reverse-engineer it.
We may suspend or close an account in the event of a serious breach of these terms, fraud, non-payment or threats towards our team. Except in an emergency, we tell you beforehand, give you our reasons and the opportunity to respond. Orders already confirmed are then either performed or refunded, as the law and the circumstances allow.
We work to keep the app available and secure, and we may update it. Interruptions may occur, in particular for maintenance.
05Part A — What you send us
Your messages, photos and documents remain yours. You allow us to use them only to handle your requests and provide the service, including by sending to a supplier what a booking requires.
When you give us information about other people, such as the travellers in a booking or the loved ones you add to My people, you confirm that you are entitled to share it, and you tell them how we use it (see our Privacy Policy).
Do not send us anything you are not entitled to share. We may remove content that is clearly unlawful. To report unlawful content or to contact us about the app, including as an authority, write to support@secunary.fr.
06Part A — Intellectual property
The app, its design, texts, images and the Secunary name and logo belong to SECUNARY or its licensors. You may use the app only for its intended purpose. Supplier names and marks belong to their owners and are used only to describe the services offered.
07Part B — Who you contract with
Every proposal states who provides what you order and who your contract is with. Three cases exist.
Secunary sells in its own name: hotel stays, restaurant reservations, yacht charters, chauffeured cars and car hire, villa stays rented in Secunary’s name, travel plans and goods (watches, bags, shoes, gifts and other items). Secunary is then your only contracting party and is responsible to you for everything it sells, even when a supplier performs it.
Travel plans: a travel plan that combines at least two different types of travel services for the same trip (for example a stay and a car, or a stay and a yacht) is a package within the meaning of article L211-2 of the French Tourism Code. Secunary is its organiser and is responsible to you for all the services it includes, even when their price is shown or paid service by service, and including a private flight that is part of it. Before you pay for a package, you receive the standard information form provided by law.
Private aviation: the air operator holding the air operator certificate is the carrier and contracts with you directly. Secunary acts as an intermediary, in the operator’s name and on its behalf. The operator’s conditions of carriage apply; we give them to you before you confirm. Secunary is responsible to you for its own concierge service.
Introductions: when a proposal says that the price is payable to a named supplier (for example the owner of a villa), you contract directly with that supplier, under its conditions, which we give you before you confirm, and you pay that price directly to the supplier: Secunary does not collect it. Secunary acts as an intermediary and only its concierge fees are due to Secunary; the proposal says if Secunary also receives a commission from that supplier.
If a proposal does not say who you contract with, Secunary is your contracting party.
08Part B — Requests, proposals and orders
A request describes what you are looking for. Your concierge replies in the app with one or more proposals, or with a sourcing report explaining what was searched when no suitable option is available.
A proposal describes the service or the good, its dates, the price including all taxes, any additional costs, the applicable cancellation conditions and the payment terms. It remains valid until the date it shows, subject to availability. It is not a reservation.
To order, you open the proposal, check the summary of what you are ordering and its total price, correct it if needed (or ask your concierge to), then confirm with the “order with obligation to pay” confirmation and complete the payment it requires. Your order is formed at that moment. We acknowledge it in the app without delay; you find it, with its documents, in your account.
For any order of €120 or more, Secunary archives the contract (the proposal, the terms you accepted and the confirmation) for ten years from the order or, if the service or delivery takes place later, until then and for ten years afterwards. You can access it at any time on request to support@secunary.fr (French Consumer Code, art. L213-1).
09Part B — Prices
Prices are stated in euros, including all taxes, before you confirm. Delivery or other additional costs, if any, are shown separately on the proposal. No fee is added for paying by card.
The price of a service sold by Secunary is set by Secunary: it may differ from the supplier’s public rate and includes Secunary’s remuneration.
Secunary may also receive commissions from some suppliers. The price shown on the proposal is the total price you pay: no other fee is charged to you.
10Part B — Concierge fees
Concierge Request Fee. Some requests carry a fee, shown before you send them. It compensates the personal work of your concierge: reviewing your request, sourcing and negotiating with suppliers, and preparing a proposal or a sourcing report. It is the price of this search service, which is distinct from the price of the service you may then order and is invoiced separately; if you order for that request, its amount is credited against the price of your order. When you pay it, your card is authorised and the fee is only charged once a proposal or a sourcing report has been delivered to you; the work has then been fully performed and the fee is no longer refundable. If you cancel before, or if we decline your request, the authorisation is released and nothing is charged. If no proposal or report is delivered within 7 days, the request is cancelled and nothing is charged.
Travel plan consultation fee (shown in the app as the travel plan deposit). Preparing a travel plan starts with a consultation call with your concierge, who then designs your trip. The fee is the price of this consultation, a service distinct from the travel plan itself; it is not an advance payment on the travel plan. It is refunded in full if you cancel before the call. Once the call has taken place, the consultation has been fully performed and the fee is no longer refundable; if you then order your travel plan, its amount is credited against the price.
Travel plan down payment. After the call, your concierge sends you your travel plan with the down payment due to confirm it, set according to your dates, travellers and destination. The down payment, the schedule for the balance and the cancellation fees are shown on the proposal before you pay. The down payment is part of the price of the travel plan and is credited against it; if you cancel, the cancellation rules below apply.
Concierge fees shown on a proposal are part of its price. If the service does not take place for a reason that is not attributable to you, they are refunded to you.
Some memberships waive certain fees: the benefits of your membership are shown in the app.
11Part B — Payment
Depending on the proposal, you pay by card or Apple Pay through our payment provider Revolut, by bank transfer to the account details shown in the app, through a secure payment page, or directly to the supplier when the proposal says so. Secunary never accepts cash. Card payments in the app are processed by Revolut: the app never transmits your card number to us.
Payment is due when you confirm your order, unless the proposal shows another due date. For a consumer, a later due date is never more than 50 days after the service is provided or the good delivered, and no interest is charged. For a professional client, it is never more than 60 days after the invoice date. A bank transfer is shown as “committed” when you confirm it in the app and as “received” once the funds have reached our account; your booking is final once the payment has been received.
If a consumer pays late, interest at the legal rate applies after a formal reminder. A professional client who pays late owes, by law, late-payment penalties at three times the legal interest rate and a fixed recovery fee of €40 (French Commercial Code, art. L441-10 and D441-5).
Invoices are available in the app.
12Part B — Compliance checks
Secunary is subject to French anti-money-laundering and counter-terrorist-financing law (French Monetary and Financial Code, art. L561-1 et seq.) and to international sanctions. Before accepting or performing an order, in particular for a watch or a piece of jewellery priced above €10,000, we may ask you for a valid identity document, proof of address, information on the beneficial owner if you act for a company, and information or documents on the origin of the funds, and we may check you against sanctions lists.
Until these checks are completed, the order and its delivery times are suspended. If the information is not provided or the checks are not satisfactory, we may refuse or cancel the order without liability; sums paid are refunded to the account they came from, subject to our legal obligations. We are not required to give the reasons for a refusal. The data collected for these checks is kept for five years, as the law requires.
13Part B — Membership
Membership is open on application, and no payment is requested before an application is accepted. Secunary may decline an application only for a legitimate reason: the number of members its team can serve is reached, the information given is inaccurate, sums remain unpaid or behaviour towards our team has been inappropriate, or the compliance checks described above are not satisfactory. Applications are never assessed on a discriminatory criterion.
Each plan (Faubourg, Worldwide) and its benefits are described in the app before you pay. A membership runs for one year from the payment. It does not renew automatically: you can renew it from the app during the last month of your year, or within twelve months after it ends. A renewal paid before the end starts when the current year ends.
Membership benefits are personal to the member and to the people the plan expressly covers. If you seriously breach these terms, Secunary may end your membership after telling you why; the unused part of the price is then refunded pro rata.
14Part B — Right of withdrawal
If you are a consumer, you may withdraw from a contract concluded at a distance within 14 days, without giving a reason: from the day the contract is concluded for a service, and from the day you receive the good for a good (French Consumer Code, art. L221-18).
There is no right of withdrawal for: accommodation other than residential accommodation, car hire, catering and leisure services to be provided on a specific date or during a specific period, such as hotel and villa stays, restaurant reservations, yacht charters and experiences booked for a date (art. L221-28 12°); passenger transport, such as private flights and chauffeured cars, whether booked for a transfer or by the hour (art. L221-2 9°); packages within the meaning of the French Tourism Code (art. L221-2 5°), which are governed by the cancellation rules below; goods made to your specifications or clearly personalised (art. L221-28 3°); and goods that are liable to deteriorate or expire rapidly, such as flowers or fresh food (art. L221-28 4°).
Concierge Request Fee and travel plan consultation fee: by paying them, you expressly ask your concierge to start working immediately, and you acknowledge that you lose your right of withdrawal once the work has been fully performed, that is once a proposal or a sourcing report has been delivered to you, or once the travel plan call has taken place (art. L221-28 1°). If you withdraw before that, the card authorisation for a request fee is released and nothing is charged; any amount already debited, including the travel plan consultation fee, is refunded in full.
Membership: you may withdraw within 14 days of the payment. If you asked for your membership to start immediately and used it during that period, the price of the period already used is deducted (art. L221-25).
Goods: you return the good, complete and in its original condition, within 14 days of telling us you withdraw. You bear the direct cost of returning it, except for watches, jewellery and leather goods, which we collect at our own expense through an insured carrier. You are liable for any loss of value resulting from handling beyond what is necessary to establish the nature and characteristics of the good.
We refund all sums paid, including standard delivery costs, within 14 days of being told of your withdrawal, using the same means of payment unless you agree otherwise. For a good, we may wait until we have received it or proof that you have sent it.
To withdraw, use the “Withdraw from contract” function on the order in the app, available throughout the withdrawal period; if you use it, we send you without delay an acknowledgement on a durable medium (e-mail), with the content of your statement and the date and time it was sent. You may also send us any unambiguous statement by e-mail to support@secunary.fr, or use the model withdrawal form at the end of these terms.
15Part B — Changes and cancellations
Before an order, you can edit a request until proposals have been sent and cancel it at any time; the Concierge fees section above says what happens to any fee already paid. Our cancellation policy, available in the app and at secunary.fr/legal/cancellation-policy, summarises each stage.
After an order, any change or cancellation follows the cancellation conditions shown on the proposal, which reflect those of the supplier. Your concierge always tells you what is possible, and what it costs, before acting.
Travel services and packages sold by Secunary (French Tourism Code, art. L211-1 et seq.): you may cancel at any time before the start of the trip by paying the cancellation fees shown on the proposal, which are appropriate and justifiable; on request, Secunary justifies their amount. You may cancel without fees, and are refunded in full, if unavoidable and extraordinary circumstances occurring at the destination or in its immediate vicinity significantly affect the performance of the contract or the carriage of passengers to the destination. The price of a confirmed order is not revised. If, because of an external event, Secunary cannot perform an essential element of the service, it tells you as soon as possible; you may then accept the change it proposes or cancel free of charge. Any refund due after a cancellation is made within 14 days.
If Secunary cancels an order, you are refunded in full, without prejudice to any compensation provided by law.
16Part B — Delivery of goods
Goods are delivered to the address you give, within the period shown on the proposal, or at the latest within 30 days of the order. The risk of loss or damage passes to you when you, or a person you designate, take physical possession of the good.
If a delivery is late, you may ask us to deliver within a reasonable additional period and, failing that, end the contract and be refunded (French Consumer Code, art. L216-1 et seq.). Please check the parcel on delivery and tell us about any damage as soon as possible.
17Part B — Legal guarantees on goods
When Secunary sells you a good, Secunary answers for the legal guarantee of conformity and the guarantee against hidden defects set out in the box below, in addition to any commercial guarantee from the maker. To use them, contact SECUNARY, 102 avenue des Champs-Élysées, 75008 Paris, France — +33 6 66 76 80 57 — support@secunary.fr, or your concierge in the app.
For a second-hand good, a lack of conformity that appears within twelve months of delivery is presumed to have existed at delivery (French Consumer Code, art. L217-7).
Second-hand goods are described in each proposal with their condition, their visible wear and the documents that come with them. If a good sold by Secunary proves not to be authentic, Secunary takes it back and refunds you in full, return costs included, without prejudice to your legal guarantees. Secunary is not affiliated with the brands whose goods it sells, unless the proposal says otherwise.
18Part B — Legal guarantees: the regulatory box
(English translation of the box required by French regulations, art. D211-2 of the French Consumer Code; the French text, in the French version of these terms, is the reference.)
The consumer has two years from delivery of the good to obtain the implementation of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.
Where the contract for the sale of the good provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.
The legal guarantee of conformity obliges the professional, where applicable, to supply all updates necessary to keep the good in conformity.
The legal guarantee of conformity entitles the consumer to have the good repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer.
If the good is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer asks for the good to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date the good is replaced.
The consumer may obtain a reduction of the purchase price while keeping the good, or end the contract and be refunded in full against the return of the good, if: 1° the professional refuses to repair or replace the good; 2° the repair or replacement takes place after thirty days; 3° the repair or replacement causes a major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming good, or bears the costs of installing the repaired or replacement good; 4° the lack of conformity persists despite the seller’s unsuccessful attempt to bring the good into conformity.
The consumer is also entitled to a price reduction or to the termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to ask for the repair or replacement of the good first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the good is unavailable for repair or replacement suspends the remaining guarantee until the good is returned in working order.
The rights set out above result from articles L217-1 to L217-32 of the French Consumer Code.
A seller who obstructs in bad faith the implementation of the legal guarantee of conformity incurs a civil fine of up to €300,000, which may be increased to 10% of its average annual turnover (article L241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the good is kept, or to a full refund against the return of the good.
19Part B — Our responsibility
Secunary performs its concierge service with care and diligence. For the travel services it sells, Secunary is responsible by law for their proper performance, including when a supplier performs them (French Tourism Code, art. L211-16). It is not liable if the failure is attributable to you, to a third party unconnected with the service where the failure was unforeseeable or unavoidable, or to unavoidable and extraordinary circumstances. If you are in difficulty during a trip, Secunary provides appropriate assistance without delay.
Where an international convention limits the compensation due by a service provider (for example for air or sea carriage), the same limits apply to Secunary. Otherwise, except for bodily injury and damage caused intentionally or through negligence, compensation due by Secunary for travel services is limited to three times the total price of the trip or stay.
You are responsible for your passports, visas, health formalities and insurance. On request, your concierge gives you general information on the formalities of your destination. We recommend travel insurance covering cancellation and assistance; it is not included unless the proposal says so.
Secunary is not liable for events beyond its control within the meaning of article 1218 of the French Civil Code (force majeure). Nothing in these terms limits Secunary’s liability for bodily injury, gross negligence or intentional misconduct, nor the rights consumers have under the law. Towards a professional client, and except for bodily injury, gross negligence or intentional misconduct, Secunary’s liability for an order is limited to the total price paid for the service or good concerned.
20Part B — Complaints
For any question or complaint, contact your concierge in the app, write to support@secunary.fr or call +33 6 66 76 80 57. We reply within 15 days.
21Personal data
How we handle your data is described in our Privacy Policy, available in the app and at secunary.fr/legal/privacy.
22Changes to these terms
We may update these terms. Each order remains governed by the version you accepted when you confirmed it. For the terms of use (Part A), we tell you about a significant change in the app before it applies; if you do not accept it, you can close your account.
23Applicable law and courts
These terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory rules of the law of your country of residence. A consumer may bring a claim before the courts of their place of residence or those of Secunary’s registered office; Secunary may bring a claim against a consumer only before the courts of the consumer’s place of residence. To the extent permitted by law, disputes with a professional client fall under the exclusive jurisdiction of the courts within the jurisdiction of the Paris Court of Appeal.
